TI-Z statement on the Kabushi and Kwacha by-elections

Transparency International Zambia (TI-Z) is concerned about the happenings around the by-elections in Kabushi and Kwacha constituencies, in which the constitutional rights of opposition candidates are seemingly being inhibited and infringed. We are also taken aback by the lack of clarity that has characterized the rulings of the Constitutional Court on these matters. In our view, the Constitutional Court, being the court of finality when it comes to constitutional matters, must deliver airtight rulings which are not open to multiple interpretations, as this exudes confusion within the judicial system.
Furthermore, there have been cases of alleged vote buying and violence from the UPND against opposition players in the by-elections, making it difficult for them to campaign freely. In the same vein, some opposition candidates have been the subject of ill-timed summons from law enforcement agencies, further inhibiting their ability to conduct their campaigns. We are also concerned that President Hichilema’s presence in the two constituencies is being used by the Zambia Police to prevent opposition candidates from campaigning in those areas. TI-Z strongly condemns these actions, as they go against the conduct of free and fair elections, and do not demonstrate a level playing field for each candidate.
We therefore urge the UPND administration to protect the constitutional rights of each individual and remember that, not too long ago, they were fighting for the same rights when in opposition. We also urge the Electoral Commission of Zambia to resist the temptation to be used as a pawn in serving partisan political interests, but instead stick to their mandate as enshrined in the constitution. In addition, we urge the Zambia Police Service to conduct themselves in a professional manner as they relate with different opposition players.
The importance of adhering to our democratic ideals and values cannot be overemphasized, and the UPND, being the party in government have an obligation to lead by example.

    Transparency International Zambia should take keen interest in the investment agreements between government and foreign mining multinational companies. Examples being the one involving Vadenta mining corporation and government for the sale of major shares of KCM and Kasanshi mine where too many concessions regarding tax exemptions and debt servicing.

    The procurement of fertilizer for the 2022/2023 farming season and the strange behavior of the energy regulation board when it comes to fuel price increments.
    As citizens we are smelling a rat!
